LIMITED WARRANTY

Landscaping, sprinkler systems, and other work performed by Aria Alfresco are warranted for the full cost of the material and labor for one year from date of installation if installed by Aria Alfresco. The limited warranty is restricted as noted in the following paragraphs: The survivability and flourishing of your plants is dependent upon a partnership between Aria Alfresco and you. Healthy plants, which are poorly installed, are our responsibility. Care and maintenance of the plant material are your responsibility.  As a condition of this limited warranty, you are responsible to properly maintain the plant material during the Warranty Period. This limited warranty shall not cover the death of plant material caused by vandalism or uncontrollable acts of nature, which shall include but shall not be limited to, high winds, hail, drought, fluids, ice, snow, and hurricane. 

PLANT MATERIAL

Watering is the primary concern for newly installed plant material. The amount of water is critical. It is possible to over water plants and in fact can be detrimental to their condition. The key to watering trees and shrubs is to keep the root ball and surrounding soil moist but not soggy or saturated. The way to accomplish this is to apply water so the moisture soaks in rather than running off the surface.

Please understand that all plant material should also be hand watered during the winter. The failure to water plants during the winter does not constitute a claim under this limited warranty.

If a plant should die and you believe it is not your responsibility, you should call your designer and give the name of the plant(s) lost. If the failure was not due to lack of proper care, we will write a replacement order and the plant(s) will be replaced within four (4) weeks of receiving notification (if during proper planting season). Replacements will be based on availability of stock, and Aria Alfresco reserves the right to substitute as required. 

Plants will be replaced once only. Replacements are not warranted. Aria Alfresco does not recommend replacement of trees except during the late spring and late fall planting seasons, since replacements are not warranted and the chance for survival is better during these times.

Deciduous trees 2 1/2″ caliper and conifers 8′ or larger are excluded from the full labor warranty. These trees will have a planting charge of $250/each. 

This limited warranty cannot be transferred. 

There will be no cash refunds. 

This limited warranty specifically excludes replacements for the following varieties: Flowering Dogwoods, Groundcovers, and Rhododendrons. 

Deciduous trees and shrubs must be given until June 1st to leaf out before calling for warranty replacements. 

There are certain varieties of trees and shrubs, which generally should not be planted in the fall. A partial list of these includes: Birch, Flowering Dogwood, Redbud, Red Oak, Scotch Pine, Azaleas, Boxwoods, Groundcovers, Hollies, and Rhododendrons. 

During the one-year limited warranty period, Aria Alfresco will visit the site a maximum of two times to remove and replace dead plant material. If necessary, Aria Alfresco will visit the site one additional time during the one-year warranty period to remove dead plants only. This corresponds to three visits to the site at no charge during the one-year limited warranty period. All trips to the site in excess of these three to either remove dead plants or install replacements will be billed at $350.00 per occurrence. 

HARDSCAPE 

Aria Alfresco provides the following limited warranty on all hardscape work. 

LABOR: 1 YEAR-Aria Alfresco stands behind our labor and craftsmanship for 1 year. If you incur any problems over that time, we will inspect services performed and provide labor to repair problem areas. This warranty does not cover failures due to conditions outside the scope of the hardscape installation. 

MATERIAL: Aria Alfresco provides no product warranty and consumers should check warranty specifications with manufacturers. If natural material is used, the homeowner should understand that natural material is subject to multiple factors that impact longevity, appearance, durability, etc.    

CONCRETE 

We cannot warranty against cracking due to the shifting soils in Colorado or puddling if over 100 sq ft., due to the hand finished nature of the product.

Some trowel marks & low spots are to be considered normal as this is hand finished work.

Hot tub pads will not be guaranteed level when integrated with a patio as one unit. Hot tub pads will puddle.    ​

Broom finish, stamping texture and color will vary in texture due to sun, wind and shade and are not considered warranty items.

This limited warranty will be permanently voided on past due accounts. Upon full payment, the limited warranty may be reinstated, at Aria Alfresco’s sole discretion, for the remainder of the original limited warranty period. The charge for reinstatement will be $450.00 for all projects under $25,000 and 5% of the project cost for all others. 

The foregoing is the sole warranty for work provided by Aria Alfresco. Aria Alfresco will not be liable for any other warranties, expressed or implied. All other warranties are excluded, including the implied warranties of merchantability and fitness for a particular purpose. There are no other warranties, which extend beyond the description of the face hereof. 

Aria Alfresco will have no liability under any circumstances for indirect, special, incidental, liquidated, or consequential damages.  This limited warranty shall be construed and applied according to Colorado law. 

No agent, salesman or installer may change the terms of this limited warranty either orally or in writing.
